Terms of Service

These terms are an agreement between you and TikiTram, LLC, which operates EventureMap. They apply to our websites, the maps we publish, the EventureMap apps for iOS and Android, and the dashboards used by businesses and curators. Using any of those means you accept these terms.

1What EventureMap is

EventureMap is a live map of what is happening in a town: daily specials, live music, events, and local promotions, posted by the businesses and organizations themselves. We provide the platform. We do not run the venues, serve the food, play the music, or host the events.

2What is on the map

Deals, prices, hours, event times, and availability are entered by the business or the organizer, and can change or sell out without notice. We do not verify them and we cannot promise they will be honored. If an offer is not honored, that is between you and the business — though we would like to hear about it, because it tells us who to work with.

3Using the app and the maps

Browsing the map is free and needs no account. You agree not to interfere with the service, scrape or bulk-download it, work around any limit we set, use it to break the law, or attempt to gain access to parts of it that are not yours.

If you installed the app from the App Store or Google Play, that store’s own terms also apply to your installation.

4Coupons, campaigns, and giveaways

Some maps run coupons, passports, and campaigns. Unless the offer says otherwise, each is limited to one per person, has an expiry, has no cash value, and is honored by the participating business rather than by us. Individual campaigns may add their own rules, and where they do, those rules are shown with the campaign and apply in addition to these terms. We may void a claim we reasonably believe to be duplicated, automated, or fraudulent.

5Business and curator accounts

If you post to EventureMap, you are responsible for the account and for everything published under it. You agree to keep your sign-in secure and to tell us promptly if it is compromised.

You also agree that what you post is accurate, that you will honor the offers you publish for as long as they are live, that you hold the rights to the text and images you upload, and that your content is lawful — including any licensing, permit, or alcohol rules that apply to your business.

Your content stays yours

You keep ownership of everything you post. You give us permission to host it, display it, resize and reformat it for different screens, and include it in maps, listings, and promotional material for the map it appears on, for as long as you keep it published. Remove it and that permission ends, except for copies already distributed or kept in routine backups.

We may decline or remove content that breaks these terms, is unlawful, or misrepresents a business.

6Paid plans

Some features are sold as a subscription or as a one-time package. The price, the billing period, and what is included are what we show you at the time you buy.

• Subscriptions renew automatically for the same period until cancelled. Cancel any time before the next renewal date and the plan runs to the end of the period you already paid for.
• Fees are charged in advance and are not refundable for partial periods, except where the law requires a refund or we say otherwise in writing.
• Prices can change. We will tell you before a change affects a renewal, and you can cancel instead.
• Prices exclude any applicable taxes.
• If a payment fails, we may suspend the paid features until it is resolved.

7Free features

We offer free features, including a first trackable promotion at no cost, and we may change or end free features. Anything you have already paid for is unaffected.

8Our name and our platform

EventureMap, our logo, and the software behind the service belong to us. These terms give you permission to use the service, not to copy, resell, or build on the platform itself.

9Suspension and ending the agreement

You can stop using EventureMap at any time, and business accounts can be closed by asking us. We can suspend or close an account that breaks these terms, creates risk for other users, or goes unpaid. If we close a paid account without cause, we refund the unused portion of what you paid.

10Disclaimers

The service is provided as it is. We do not promise it will be uninterrupted, error-free, or that the information on it is complete or current. To the extent the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11Limits on liability

To the extent the law allows, we are not liable for indirect, incidental, or consequential damages, for lost profits, or for anything that happens at a venue you found through the map. Our total liability for any claim relating to the service is limited to what you paid us in the twelve months before the claim, or one hundred dollars if you paid us nothing.

Some states do not allow these limits, in which case they apply to the fullest extent those states permit.

12If your content causes a problem

If you hold a business or curator account, you agree to cover us for claims, losses, and reasonable legal costs arising from what you posted, from an offer you did not honor, or from your breach of these terms.

13Governing law

North Carolina law governs this agreement, without regard to its conflict-of-law rules. Disputes belong in the state or federal courts located in New Hanover County, North Carolina, and we each agree to those courts.

14Changes to these terms

We may update these terms. The date at the top is the latest revision. If a change is material, we will give notice on this site or by email to account holders before it takes effect, and continuing to use the service after that means you accept it.
